User Images Search on empty parameter

Well the title says it all but i noticed this as i am working on a theme.

So basically when you are searching for an image on route "mysite.com/search/images/"
If no parameter is given or the parameter ?q is empty then a 404 should appear but in this case
on route "mysite.com/rodolfo/search/images/"

Its a Fatal error [400]

Shouldn't it be 404 (from "mysite.com/search/images/")?

Note: it only does this if ?q/?q= is included otherwise its a 404 like it should be

Really nothing "that major" just wanted to report it.
