1. For the error in line 454, in both local and remote test servers I didn't notice that warning. It seems that some PHP setups with some old settings maybe scream a warning with that. I will edit it and re-upload 3.6.1
2. The touch() warning is also weird because according to the docs the touch() function doesn't scream a warning message. http://php.net/manual/es/function.touch.php

Most likely you are running in safe mode or maybe another deprecated setting is turned on.

You can try re-downloading and re-installing 3.6.1

P.S. Can you please refer to system versions as 3.6.0 and 3.6.1 in the future?

I'll make sure I reference the correct versions in the future. I redownloaded 3.6.1 and was met with this error in the apache error log:
