Strictly, Open Source comes with certain rules or freedoms http://www.opensource.org/docs/osd
I can do a commercial open source project but I can't restrict it's redistribution (in order to accomplish the open source definition)... So if I want to avoid certain freedoms I'm not longer in the Open Source category, even if the code is not encoded, or it can be modified, etc.
